By using our Services, you agree to the collection and use of information in accordance with this Privacy Policy.

1. Information We Collect

1.1 Personal Information

We may collect personal information that you provide directly to us, such as your username, profile picture, posts (‘zaps’) and any other information you choose to provide. We do not sell any of your data to third parties.

1.2 Usage Data

We may automatically collect information about your interactions with our Services, such as IP address, device information, operating system, pages visited, links clicked, and other usage data. This information helps us understand how users interact with our Services and allows us to improve them. 

1.3 User-Generated Content

We collect and store the content you save or send on zapped, including text, images, and other media. Users retain ownership of all content they create. However, we cannot control or prevent the distribution of images that have been screenshotted or saved by other users.

1.4 Location Data

We provide users with the option to add a location when creating a caption, taking a picture or uploading an image. This location data is stored privately in our database for the user, but can be shared if the user chooses to include it in a post sent to other users.

Users have full control over their location data and can:

  • Delete all location names to remove the location and its corresponding data from our database; deleting location names can be done from the ‘place’ popup when in that location.

  • Pause location tracking within the app to prevent future location data from being stored in our database (or used in captions).

  • Disable location access through their device settings, which prevents the app from accessing location services.

1.4.1 Location Tracking

Lightspark Games LLC does not track your location when the app is in the background or closed. Location may be tracked when the app is open to contribute to the app’s experience and functionality.

1.4.2 No Liability for Shared Locations

Users are responsible for ensuring the accuracy and privacy of the location data they share. Lightspark Games LLC:

  • Does not verify or endorse any location data submitted by users.

  • Is not liable for any consequences resulting from the sharing of location data, including but not limited to privacy risks, misrepresentation, or unauthorized access by third parties.

1.4.3 Third-Party Services and Location Data

We do not share location data with third parties, except where required by law or if explicitly integrated with a third-party service (e.g., Apple Maps for location selection, if applicable). Users should review their device settings and permissions to control location sharing within our app.

1.5 Account Authentication and Phone Number Verification

We use phone number verification for account authentication. When you sign up or log in, we may send a one-time verification code to your phone number to confirm your identity. This phone number is stored securely and is used only for authentication purposes.

We do not share or sell phone numbers to third parties. Your phone number will not be publicly visible within the app.

1.6 Facial Data and AI Processing

When using our AI image-generation features, you may submit images containing faces. These images are processed by third-party AI services, including Bytedance's Pulid model on Replicate ("Third-Party AI Services").

We do not own, store, or retain facial images beyond what is necessary to generate AI-modified images.

Images are sent to and processed by Replicate and its AI providers, which may have their own data policies.

We do not control how Replicate or its partners store, process, or use submitted images. By using our Services, you acknowledge that your images may be subject to Replicate's data practices.

You assume all risks associated with submitting images for AI processing and acknowledge that we are not liable for how third-party services handle the data.

1.7 No Ownership Over AI-Generated Content

Lightspark Games LLC does not claim ownership over AI-generated images created using third-party AI models. Users retain ownership of AI-generated content associated with their account, but:

  • We do not verify or endorse the originality, accuracy, or legality of AI-generated images.

  • Users are solely responsible for ensuring their AI-generated content does not infringe on intellectual property, publicity rights, or privacy laws.

  • We do not provide copyright protection or guarantee that AI-generated images are unique, free from bias, or compliant with third-party rights.

1.8 University & College Affiliation

When users provide a university or college affiliation within zapped, this information is collected as part of their account data. Lightspark Games LLC does not verify, validate, or confirm the accuracy of university or college affiliations provided by users.

Affiliation information is treated as user-provided content, and users are solely responsible for ensuring its accuracy. Lightspark Games LLC assumes no liability for any misrepresentation, inaccuracies, or disputes arising from false or misleading affiliations. If a university or college requests removal of an affiliation, we reserve the right to modify or delete the information at our discretion.

2. How We Use Your Information

2.1 To Provide and Improve Our Services

We use your information to operate, maintain, and improve our Services, including personalizing your experience and providing you with relevant content and features.

2.2 To Communicate with You

We may use your information to send you in-app notification updates, marketing materials, and other information that may be of interest to you. You can opt-out of receiving these communications at any time.

2.3 To Analyze and Understand Usage

We use usage data to analyze trends, track user activity, and gather demographic information. This helps us understand how users interact with our Services and identify areas for improvement.

3. Sharing Your Information

3.1 Third-Party Services

We use third-party services, such as OpenAI for AI caption services, Google’s Gemini API for vision, Replicate’s AI image APIs and Google’s Firestore for backend data storage and app management, among others. These third parties may have access to your information as necessary to perform their functions. We do not control how these third-party services manage user data, and we encourage users to review their Privacy Policies for more details.

By using our Services, you agree that your images may be processed by third-party AI providers outside our direct control. Lightspark Games LLC is not responsible for any data leaks, breaches, or misuse by third-party providers.

3.2 Legal Requirements

Lightspark Games LLC may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., a court or a government agency).

3.3 Business Transfers

In the event of a merger, acquisition, or sale of all or a portion of Lightspark Games LLC's assets, your information may be transferred to the acquiring entity.

4. Data Security

We implement appropriate technical and organizational measures to protect your personal information against unauthorized access, loss, destruction, or alteration. However, please be aware that no security measures are perfect or impenetrable, and we cannot guarantee absolute security.

4.1 Data Breach Notification

We take reasonable measures to protect your data; however, no system is completely secure. In the event of an unauthorized access, security breach, or data compromise, we may:

  • Investigate the issue and take appropriate actions to protect affected users.

  • Provide notifications as required by applicable laws.

  • Work with third-party providers if the breach involves external services.

5. Data Retention

We retain your personal information for as long as necessary to provide our Services, comply with legal obligations, resolve disputes, and enforce our agreements. User-generated content may be retained indefinitely unless you initiate deletion or request deletion.

  • Facial images submitted for AI processing are stored indefinitely by Lightspark Games LLC., but the user can delete any of their uploaded face images.

  • These images are sent to third-party AI services (e.g., Replicate) for processing and may be subject to their data retention policies.

  • Although users can delete AI-generated images within the app, this does not guarantee deletion from third-party platforms once processed, as we do not control how long third-party AI providers retain images.

6. Your Rights

6.1 Access and Update

You have the right to access and update personal information such as your username, profile picture, and privacy status on a post (known as a ‘zap’). You can do this through your profile page.

6.2 Deletion

You may delete your account from profile settings. We may retain information about a post (‘zap’) or reply, if either was reported to us. To meet legal requirements that can arise, we may retain your post and user information on our server for up to 60 days after deletion. AI-generated images deleted from a user’s account do not guarantee removal from third-party AI providers.

6.3 Opt-Out

You can opt-out of receiving marketing communications (if any) or opt-out of in-app notifications from us at any time via your device settings.

7. Children's Privacy

Our Services are not intended for children under the age of 13. We do not knowingly collect or process facial images or other biometric data from children under 13. If we become aware that such information has been collected, we will take steps to permanently delete it from our database.

7.1 Limitation of Liability

Lightspark Games LLC is not responsible for how third-party AI services process or store submitted images.

Users assume all risks when submitting facial images for AI processing and acknowledge that third-party providers may have their own data retention policies.

Lightspark Games LLC does not assume responsibility for AI-generated images, including legal claims, reputational damage, or unintended consequences arising from their use.

7.2 University & College Affiliation Disclaimer

By affiliating a user with a university or college within the zapped platform, Lightspark Games LLC does not imply or guarantee any official endorsement, approval, or partnership with the listed institution.

Users are solely responsible for ensuring the accuracy of their affiliation and must not falsely claim association with an institution. Lightspark Games LLC does not verify, validate, or confirm university affiliations and assumes no liability for any misrepresentation, damages, or disputes arising from incorrect or misleading affiliation claims.

If a university or college requests removal of a claimed affiliation, Lightspark Games LLC reserves the right to modify or remove the affiliation at its discretion without notice.

8. Changes to This Privacy Policy

Lightspark Games LLC may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on our website and updating the "Effective Date" above. Your continued use of our Services after such modifications will constitute your acknowledgment of the modified Privacy Policy.
